to multiple published reports, a federal judge on Tuesday (April 28) denied the self-written motion submitted by Bankman-Fried, who is serving\u00a0<a href=\"https:\/\/www.pymnts.com\/legal\/2024\/lying-evasive-ftx-founder-sam-bankman-fried-gets-25-year-sentence\/\">25 years in prison<\/a>\u00a0for his role in the multi-billion dollar collapse of the FTX crypto exchange in 2022.<\/p>\n<p style=\"font-weight: 400;\">In this motion, 34-year-old Bankman-Fried had argued there were new witnesses whose testimony would justify a new trial. Judge Lewis Kaplan, who <a href=\"https:\/\/www.pymnts.com\/cpi-posts\/sam-bankman-fried-seeks-new-trial-while-serving-25-year-sentence\/\">presided over the trial<\/a>, deemed this claim baseless.<\/p>\n<p style=\"font-weight: 400;\">\u201cNone of the witnesses, for example, is \u2018newly discovered.\u2019 Bankman-Fried well before trial knew all three of them and purportedly knew also what he hoped they would say were they to testify,\u201d the judge said. \u201cHe could have obtained or at least sought to compel their testimony. But he did neither.\u201d<\/p>\n<p style=\"font-weight: 400;\">The judge called Bankman-Fried\u2019s assertion that the three former FTX executives were prevented from testifying on his behalf by government threats and retaliation is \u201cwildly conspiratorial and entirely contradicted by the record.\u201d<\/p>\n<p style=\"font-weight: 400;\">While Bankman-Fried is also appealing his conviction and sentence via his lawyer, he made this motion on his own, per a <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2026-04-28\/sam-bankman-fried-s-motion-for-new-trial-rejected-by-us-judge\" target=\"_blank\" rel=\"noopener\">report<\/a> from Bloomberg News.<\/p><div id=\"pymnt-2397032245\" class=\"pymnt-content pymnt-entity-placement\" style=\"margin-top: 50px;\"><p style=\"text-align:center\">Advertisement: Scroll to Continue<\/p><script async type=\"text\/javascript\" id=\"dianomi_context_script\" src=\"https:\/\/www.dianomi.com\/js\/contextfeed.js\"><\/script> \r\n<div class=\"dianomi_context\" data-dianomi-context-id=\"4329\"><\/div><\/div>\n<p style=\"font-weight: 400;\">That report notes that this strategy seems to have annoyed the judge, who said the motion appeared to be \u201cpart of a plan to rescue his reputation that Bankman-Fried hatched and even committed to writing after FTX\u00a0<a href=\"https:\/\/www.pymnts.com\/legal\/2025\/ftx-to-distribute-5-billion-to-creditors-in-second-distribution\/\">declared bankruptcy<\/a>\u00a0but before he was indicted.\u201d<\/p>\n<p style=\"font-weight: 400;\">According to a <a href=\"https:\/\/gizmodo.com\/sam-bankman-fried-seems-to-annoy-judge-and-lose-latest-motion-for-new-trial-2000752001\">report<\/a> from Gizmodo, this \u201cplan\u201d is an apparent reference to evidence released by the prosecution in 2024, a document written by Bankman-Fried before his indictment. It included what he described as \u201cprobably bad ideas\u201d such as appearing on Tucker Carlson\u2019s TV show to establish himself as a Republican.<\/p>\n<p style=\"font-weight: 400;\">(Bankman-Fried would eventually be\u00a0<a href=\"https:\/\/www.pymnts.com\/cryptocurrency\/2025\/ftxs-sam-bankman-fried-reportedly-lobbying-trump-for-pardon\/\">interviewed by Carlson<\/a>, though only after he was sentenced to prison.)<\/p>\n<p style=\"font-weight: 400;\">Bankman-Fried was convicted of seven criminal counts including fraud and conspiracy, after jurors found he illegally shifted billions from FTX customers to Alameda Research, the company\u2019s sister hedge fund. Risky investments at Alameda helped fuel FTX\u2019s downfall, which rocked the cryptocurrency sector.<\/p>\n<p style=\"font-weight: 400;\">At trial, jurors heard from several\u00a0<a href=\"https:\/\/www.pymnts.com\/cryptocurrency\/2025\/3-former-executives-involved-with-ftx-agree-to-sec-final-judgments\/\">former FTX executives<\/a>\u00a0who said Bankman-Fried had directed them to commit fraud. Among them was Caroline Ellison, former head of Alameda and sometimes-romantic partner of Bankman-Fried.
